The above audit protocols have been released by NYS OMIG for audits of the above programs. MSC: Effective Dates 5/15/13, Day Habilitation Effective 5/2/13, IRA Residential Habilitation Effective 5/2/13 and Day Treatment Effective 3/29/13.
Per OMIG Memo: “Audit protocols are applied to a specific provider or category of service in the course of an audit and involve the OMIG’s application of articulated Medicaid agency policy and the exercise of agency discretion. OMIG,consistent with state and federal law, can pursue civil and administrative enforcement actions against any individual or entity that engages in fraud, abuse, or illegal or improper acts or unacceptable practices perpetrated within the medical assistance program.”
